Lululemon Settles Lawsuit

Lululemon Athletica has settled a lawsuit that accused Calvin Klein of infringing on a patent on a pair of yoga pants.

The details of the settlement are confidential, but Lululemon will start the process of withdrawing the case as part of the agreement according to recent reports.

"We cannot comment on this case as the terms of the settlement are confidential," Lululemon representative Sari Martin told the Globe and Mail. "Lululemon values its products and related [intellectual property] rights and takes the necessary steps to protect its assets when we see attempts to mirror our products."

The lawsuit, which was filed in a Delaware court in August, claimed that Calvin Klein's "Performance" brand pants resembled Lululemon's Astro Pant and compression overlapping waistband, infringing on three patents held by Lululemon.

The fashion industry has been watching closely since some legal and fashion experts have suggested that this case could set a precedent for future design patent cases.
