Lululemon Sues Calvin Klein

The Vancouver yoga-lifestyle outfitter accuses pant design patent infringement.

Canadian clothing company Lululemon Athletica Inc. has sued Calvin Klein, accusing the designer of copying yoga pant designs. The lawsuit asks for damages, including lost profits and royalties, for alleged infringement on three of Lululemon’s patents.

The complaint, filed in federal court on Aug. 13 in Wilmington, Delaware, references Calvin Klein’s “Performance” brand pants, reported Bloomberg. The patented Lululemon design is on the Astro Pant with performance compression overlapping waistband.

“The accused products include substantially the same waistband design elements and pant style,” Lululemon said in the complaint.

Lululemon has grown so popular that other companies are watching closely.

Earlier this month, it was reported that competitor Athleta, which is owned by the Gap, is setting up stores near Lululemon’s retail locations.
